Abstract: يُعد موضوع التطرف من الموضوعات التي فرضت نفسها على الفكر القانوني والسياسي على حد سواء، حيث تزايد في الآونة الأخيرة وأصبح يهدد أمن واستقرار الدول، ولَمَا كان سيف القانون هو من أهم الأساليب في مواجهة التطرف، فقد سارعت الدول المتضررة منه إلى سن قوانين وتشريعات تتناسب مع حجم وخطورة هذه الظاهرة. وتُعد هذه الظاهرة من الظواهر الغامضة وهذا هو مكمن خطورتها على المجتمعات؛ لأن ما يحدث من أعمال إرهابية في أقطارنا العربية التي راح ضحيتها العديد من الأبرياء، وتدمير للمنشآت الحيوية العامة والخاصة والخسائر المادية، أمر يستحق البحث والدراسة، وليس هناك أغلى وأعز من الوطن وأمنه، ولكؤن صور الجرائم التي يجسدها التطرف كثيرة ومتعددة، الأمر الذي يوجب وجود نصوص دستورية تستوعب التطور المتسارع بما يكفل حقوق وحريات أفراد المجتمع، ولمواجهة التطرف يتطلب قيام الدولة بمكافحة هذا الخطر في جميع مجالات الحياة، وأن لا تقتصر المواجهة على النصوص الدستورية والقوانين العقابية، بل الاعتماد على إستراتيجية لمكافحة التطرف.

The phenomenon of extremism is one of mysterious phenomena, and this is where its danger lies for societies, because what is happening in terms of terrorist acts in our Arab countries, in which many innocent people have been killed, and destruction of vital public and private facilities and material losses, is a matter that deserves research and study, and there is nothing more precious and dear than the homeland and its security , and because the forms of crimes embodied by extremism are many and varied, which necessitates the existence of constitutional texts that accommodate rapid development in a way that guarantees the rights and freedoms of members of society, and to confront extremism requires the state to combat this danger in all areas of life, and that confrontation is not limited to constitutional texts and punitive laws, but relying on a strategy to combat extremism. The phenomenon of extremism is one of the most enigmatic phenomena, and herein lies its danger to societies. This is particularly evident from the terrorist acts occurring in our Arab nations, where many innocent lives have been lost and significant damage to both public and private vital facilities has occurred, resulting in substantial material losses. Such circumstances necessitate thorough research and study. There is nothing more precious and cherished than the safety and security of our homeland. Given the diverse and evolving forms of crimes that are manifested through extremism, it is imperative to have constitutional texts that can adapt to rapid developments while safeguarding the rights and freedoms of society’s members. Combating extremism requires a comprehensive approach from the state, addressing this peril across all facets of life. This confrontation should not be confined to constitutional provisions and punitive laws; instead, it necessitates a strategy grounded in a broader effort to counteract extremism effectively.
